3. Section 140 Of The Motor Vehicle Act

3. Section 140 of the Motor Vehicle Act,1988

This section pertains to the application for compensation in cases of HIT AND RUN ACCIDENTS.

When a motor vehicle is involved in an accident and the driver responsible for the accident flees the scene without providing their information, it is considered a hit and run case.

In such instances, the victim or their legal representatives can make an application for compensation under Section 140 of the Act.

Important factors regarding the application under Section 140 of the Motor Vehicle Act:

1. Hit and Run Accident:

The provision applies specifically to accidents where the identity of the vehicle or the driver involved is not known, either because they fled the scene or failed to provide their details.

2. Application for Compensation:

The victim or their legal representatives can submit an application for compensation to the Motor Accident Claims Tribunal or a similar designated authority. This application should include relevant details about the accident, the injuries suffered, and any other relevant information.

3. Time Limit:

The application should be filed within a specific time limit, typically within six months from the date of the accident. However, the tribunal may consider applications filed after this period if it is satisfied with the reasons for the delay.

4.  Compensation Determination:

The tribunal will consider the application and assess the compensation amount based on the nature of the injuries, disability, and other relevant factors. The compensation awarded will typically cover medical expenses, loss of income, and other damages suffered as a result of the accident.

5.  Source of Compensation:

In hit and run cases, where the identity of the driver or the vehicle is unknown, the compensation is typically paid from the Solatium Fund. The fund is established by the government to provide compensation to victims of hit and run accidents and is financed through a portion of the premium paid by vehicle owners for third-party insurance.

It's important to note that specific procedures and requirements may vary based on the jurisdiction and the applicable laws in a particular country or state. Therefore, it is advisable to consult the relevant laws and regulations in your specific jurisdiction for accurate and up-to-date information regarding applications for compensation in hit and run cases under Section 140 of the Motor Vehicle Act.
