27. Transfer of Property
Under Section 5 of the Transfer of Property Act, 1882 – An Act by which a living person conveys property, in present or in future to one or more other living persons or to himself and one or more other living persons; and to transfer property means to perform such act.
Transfer of any Property is basically governed and controlled by Three Acts :
1. Transfer of Property Act, 1882,2. The Registration Act, 1908,
3. The Indian Contract Act, 1872.
Apart from The Stamp Duty Act – If a document is not stamped or sufficiently stamped as required by that Act, the document would not be invalid.
Transfer of any Property by following ways :
1. Sell Or Purchase Of Property,2. Gift,
3. Release,
4. Will,
5. Exchange,
6. Collector / Tahsildar Order,
7. Court order.
