Criteria of registration of documents is executed as per the provisions mentioned under The Registration Act, 1908.

Time for presenting documents - After drafting the deed, both side parties thumb & signature has been executed from that date, subject to the provision contained in section 24, 25 and 26, no document other than a will shall be accepted for registration unless presented for that purpose to the proper officer within four months from the date of its execution: Probability that a copy of a decree or order may be presented within four months from the date on which the decree or order was made, or, where it is appealable, within from the day on which it becomes final.


AFTER DRAFTING THE DOCUMENT AND PREPARING ANNEXURE :

 1 .  VALUATION PROCEDURE :

In this Advocate has to remove valuation of the Property.

Department of Registration and Stamps of each state wise, provides Rate of each type of Property (such as Land, Flat, Office, Commercial Area and Industrial Area ) as per Village and its Survey Number wise which is called as Ready Reckoner Rate on its website / portal.

Rate per Sq. Mtr. is calculated with area of property from which valuation is calculated.

All guideline is given under their manuals how to calculate it.

Advocate has to get reconfirmed from the Sub Registrar before paying and generating the E - Challan of stamp duty & registration Fees.

In this Generally Valuation is categorized in two types :

1. Government Value - Calculated as per Ready Reckoner Rate,

2. Market Value - The Price at which such property would have fetched it sold in open market on the date of execution of such instrument or consideration stated.

In this Stamp Duty & Registration Fees has to be paid on Higher Value as per percentage wise which is directed in the Reckoner Rules & Regulations and by time to time updated by the notification.

Stamp Duty & Registration Fees might be varying as per state to state, Village to Village, City to City and as per document wise.

2 . PAYMENT OF VARIOUS DUTIES :

STAMP DUTY & REGISTERATION FEES :

After confirming how much Stamp duty & Registration Fees to pay, then the Advocate has to visit the portal website to pay the duty.

While Filling the E Challan concern to :

Land : Village Name, Taluka, District, Survey / Gat / Sector No., Pin code.

Unit : Village, Survey / Gat / Sector No., Pin code., Project Name, Phase, Wing, Unit No. as to be paid with concern amount without any spelling mistakes properly.

Do mentioned exact & accurate information of property details plus stamp duty & registration amount.

If mistake occurs then that E Challan cannot be used and need to apply to the higher authorities for refund of the same amount which is time consuming and penalty is charged.

And client is not willing to wait for the amount for your’s mistake, you might have to bare the loses.

And again at the same time new amount Challan has to be paid for that current document.

DOCUMENT HANDLING CHARGES (D.H.C.) :

In this before registration of any deed total pages is calculated plus additional 5 pages are added (Valuation Page, Defaced Challan, Photo Page, Stamp Duty paid page one additional) and Challan for those pages are paid, each page cost Rs.20/- which has to paid and get generated Challan of if to attach the document.

3. PREPARING DATA FEEDING PAGE :

Before registration of document, data feeding has to be filled. In this all detail summary of transaction is displayed.

Such as – Registrar Office Details, Title of Deed, Government Value, Market Value, Property Description, Purchaser Party & Seller Party details, Date of execution, Date of Registration, Advocates Name, Age and Address. Do get checked all data types is correct from clients before going to registration procedure.

After getting registered same data gets confirmed as Index II.

4.  SUBMISSION OF DOCUMENT :

 
After Preparing Draft, Attaching Annexure plus Stamp Duty, Registration Challan plus DHC Challan same set has to be provided at Registration office before the Sub Registrar.

 

Sub Registrar inspects all the documents, provide the same to the operator to generate the data, and get defaced all Stamp Duty, Registration, DHC Challen’s.

And after deface of all Challen’s the operator takes the Photo and left Thumb impression online of parties to the agreement and generate the print of that photo page, the parties sign on that pages and forwarded the same to signature of Sub registrar and after sub registrar sign they are forwarded to scan. Index II gets generated which was earlier data feeding done by the Advocate. This is the last procedure of registration of document.
