19.  COURT POWER TO SELL MOVABLE PROPERTY 


Interlocutory Orders Order 39 Rule 6 to 10 :


Rule 6 to 10 of Order 39 deals with Interlocutory Orders. The Court has power to order sale of any movable property which is subject matter of suit or attachment before judgement in such suit which is subject to speedy & natural decay & for desirable & just & sufficient cause desirable to be sold at once.


It can also order for detention, preservation or inspection of any property which is the subject matter of suit & for that purpose it can authorised any person to enter upon or into any land or building in possession of any other party for the purpose of taking inspection or obtaining information’s.


However before making such order the court shall give to opposite party where the subject matter of suit is money or some other thing capable of being delivery & a party to suit admits, that he holds such money or thing as a trustee, the court may ordered to be deposited in court or delivered to be deposited in court or delivered to that party or without security.
